Serving as a veteran in Vietnam and contributing services to the fire department, Dan White serves on the Board of Supervisors with Harvey Milk, a gay rights activist. Dropping out of office in the year of 1978 on November due to the fact that he no longer can support his family with the current salary, Mayor George Moscone grants him the opportunity to come back with the same position he once had. When White requests for his original position back one day, Moscone refuses to reappoint him since White votes against Milk’s gay rights ordinance.
As what seems a normal day approaches the next day, White sneaks past security for weapon inspection into City Hall through a window with a .38 revolver with fresh bullets. Discovering Moscone, white discharges 4 bullets towards him and 5 bullets towards Milk ending his actions with point-blank shots to the head. Claiming responsibility, White turns himself in to the police on the same day. White's defense supports his action with his state of depression instead of the idea of planning a conspiracy beforehand. What else plays a role in his depression? His overconsumption on junk food. By consuming excessive amounts of food that does nothing to one's health except damage, defense argues it is the cause of White's violent actions. This junk food trial became known as the ”Twinkie Defense".
